Installation Disclaimer and Waiver

1. Acknowledgement of Installation Responsibility
By proceeding with the purchase and/or installation of tennis court line products supplied by Jadee Sporting Distributors Pty Ltd (“the Company”), the purchaser and/or installer (“the Customer”) acknowledges and agrees that they are solely responsible for ensuring the product is installed correctly and safely.

2. No Liability for Incorrect Installation
The Company does not accept any responsibility or liability for any loss, damage, injury, or defect arising from or related to incorrect, improper, or unsuitable installation of the product. This includes, but is not limited to:

  • Misalignment or improper positioning of court lines

  • Damage to the product during installation

  • Damage to the court surface or surrounding infrastructure

  • Reduced product performance or lifespan

3. Recommendation for Professional Installation
The Customer acknowledges that installation of tennis court lines, particularly for clay courts, requires a high level of precision and skill. The Company strongly recommends that installation be carried out by a qualified and experienced professional with expertise in tennis court line installation.

4. Assumption of Risk
The Customer assumes all risks associated with the installation process, including any risks arising from engaging third-party installers. The Company will not be liable for the actions, omissions, or workmanship of any third-party installer.

5. No Warranty on Installation
Any warranties provided by the Company apply strictly to the product itself (subject to applicable terms and conditions) and do not extend to installation. Improper installation may void any applicable product warranty.

6. Indemnity
To the fullest extent permitted by law, the Customer agrees to indemnify and hold harmless Jadee Sporting Distributors Pty Ltd, its directors, employees, and agents from and against any claims, damages, liabilities, costs, or expenses arising from or related to the installation or use of the product.

7. Australian Consumer Law
Nothing in this waiver is intended to exclude, restrict, or modify any rights or remedies that the Customer may have under the Australian Consumer Law or any other applicable legislation, which cannot be excluded by law.

8. Acceptance of Terms
By proceeding with this purchase and installation, the Customer confirms that they have read, understood, and agreed to the terms of this disclaimer and waiver.
